Newburyport Conservation Commission Continues Gabion Wall Case, Schedules Plum Island Site Visit

Newburyport Conservation Commission continues two Plum Island cases and hears warning on new state zoning law. The commission voted 6-0 twice at its July 21 Zoom meeting to continue a certificate-of-compliance request from Carrie Fowler at 137 Old Point Road and a notice of intent for a proposed gabion retaining wall at 9 Louis Street, both to August 4. Member Julia Godforson raised a pointed objection to the gabion proposal, saying "we don't allow hard structures and nor do we allow retaining walls" on Plum Island and warning that approving one would set a difficult precedent; engineer Israel Burr of Burr Engineering argued that limited space — a roughly four-foot elevation change in less than five feet of horizontal clearance — made a bioengineered slope solution infeasible.

The full commission scheduled a site visit for 1 p.m. Monday, July 27. City Planner Andy also briefed the commission on a Zoning Act amendment embedded in the state's fiscal year 2027 budget, describing it as "the most sloppy of the three recent things we've seen" and warning it could give Plum Island property owners new as-of-right grounds to expand structures beyond limits the local overlay district currently imposes.
